FAIRFAX UPDATE: Labor has regained a slender lead in the national two-party preferred vote, one of the key elements Prime Minister Julia Gillard has relied on to argue her party has the better right to form a minority government.

Late last night, Labor's two-party lead had dramatically turned into a deficit of about 1900 votes - with nearly 10.7 million counted - giving the Coalition a lead on both the primary and two-party vote.

But, as at midday, further counting had put Labor back in front by more than 700 votes.

EARLIER: The Opposition says Julia Gillard's government is no longer legitimate, as latest counting shows Labor is behind in the two-party vote.

The day after the election, Julia Gillard claimed that Labor is the legitimate government because, at the time, it was clear they had 'the majority of the two party preferred vote'.

She claimed this was a 'critical fact' as to why Labor should retain power.

Late last night, Labor's two-party lead had remarkably turned into a deficit of around 1,900 votes after 10.7 million were counted.

The Coalition now leads both the primary and preference vote.

Neil Mitchell says that the only interpretation of this turn around, and based of Gillard's own criteria, is that Julia Gillard backs Tony Abbott.

  • The Coalition was NEVER ahead on the two party preferred. The figures have been proven to be dodgy. The fact this story's still on page one of the 3AW site speaks volumes about the station's credibility. Mitchell should employ a fact checker rather than relatives of conservative politicians and right wing thinktankers.

  • The 3-Amigos are only face of Australians prepared to stick their neck out for their electorate. The sitting members couldn't care less for those constituents and thus lost their favor with the voter. These three are the willing fighters for their electorate and have the upper hand to extract their pound of flesh.

  • The country is doing very fine thank you, if you notice we have no captain but 4 captains, and the sky has not fallen in, talk about being brain washed. Take your time Independants, i want whats best for the Country, Not Political Party's.

  • If Julia has any decency, she will support the Liberals in power and help them get "good policy" through the house without having to bow to the clown gallery. The distance between labor and liberal thinking is much closer than that between either party and the fringe minority single issue members. The days when you vote agaist an issue simply because your party did not come up with the idea are now over. Tony should involve the labor shaddow ministers in decision making and we can then negate the clowns alltogether.

  • Let us cease this election circus:
    1) let the people vote again
    or
    2) Toss a coin and put either Abbott or Gillard in charge
    I agree with other listeners that the Australian public should not have to be held at ransom by 3 independent self interested blokes. A new hospital in Tassie which is not in the budget? Why not build them a bridge accross the Strait so they don't get their feet wet comming over to the mainland. Quite ridiculous!

    I would just like to say that I have had enough of the 3 musketeers trying to pull rank over Australia. Lets face it, all they are interested in, is themselves and what will get them re elected next election! Its a bloody disgrace!
