3AW REPORT: A 3AW listener alerted the Neil Mitchell program on Friday Simon Overland received extra attention by security at Canberra airport on Thursday.

It turns out Chief Commissioner Overland was carrying a magazine containing bullets.

Neil Mitchell wonders how Overland was allowed to fly from Melbourne to Canberra with the bullets.

MEGAN LEVY: Victoria’s top police officer has been caught carrying bullets on a domestic flight - an offence that carries a maximum seven-year jail term.

It is unclear whether Chief Commissioner Simon Overland will be charged after he was stopped at Canberra Airport with a magazine containing three live rounds of ammunition yesterday afternoon.

Mr Overland had already flown from Melbourne to Canberra that day with the bullets in his hand luggage. It was not until he attempted to board a Qantas flight back to Melbourne that Australian Federal Police (AFP) officers discovered the security breach. A statement from Victoria Police confirmed the incident, but stressed that it had been a mistake and a genuine oversight.

The statement said Mr Overland had removed a firearm from his bag prior to travel, however he overlooked removing the magazine.

Carrying dangerous goods on board an aircraft without permission is a breach of the Civil Aviation Act 1988.

It can result in a maximum seven-year jail term if the breach was intended, or a two-year jail term if it was not intended.
However an AFP spokesman could not immediately say if Mr Overland would be charged.

He said Mr Overland was fully co-operative when the bullets were discovered in his bag and the matter has been referred to the Office of Transport Security.

Qantas, which is responsible for its own security screening, has launched an investigation to determine how the bullets passed through security undetected.

The head of the police union, Senior Sergeant Greg Davies, said most people would be ‘‘slapped in handcuffs’’ if they were caught carrying a magazine of live bullets onto a plane.

‘‘On the one hand it is not a big deal: the police chief commissioner is not going to hijack a plane to go to Cuba or create any threat,’’ he said.

‘‘At the other end of the scale, if it was a constable or member of the public you would be hung, drawn and quartered ... you and I would still be in handcuffs and remanded in custody.

‘‘I am not sure which end of the scale it should be but you can’t carry a set of nail clippers onto a plane.

‘‘Due process should take its course, but Mr Overland would be the first to say there should be one rule for everyone.’’

A witness, Archie, told Radio 3AW that he witnessed Mr Overland being patted down in Canberra.

‘‘A bloke that looked like Simon Overland ... was being searched by AFP police as his bag went through that scanner,’’ he said.

‘‘I had an explosive test on me and the guys said to me that they’d found bullets in his bag.’’

A Qantas spokeswoman confirmed Mr Overland had cleared security at the airline’s domestic terminal in Melbourne with the ammunition his carry-on luggage.

‘‘We can confirm he passed through a security screening point at the Melbourne number one domestic terminal.’’

‘‘It is something we are taking very seriously, an investigation is already under way with the contract security provider and the Australian Federal Police and the Office of Transport Security

  • Overall the reaction to Simon Overland's recent bullet breach is just not sensible. Simon Overland has a vital public position as Chief Commissioner of the Victoria Police. The reaction against him on this minor matter is over-the-top. It was simply an oversight, and one that a man in his position should not normally make. But it remains just that, an oversight, without any criminal intent. People, the hungry dramatic media particularly, need to just calm down. Overland may be many things, he may particularly be overly excited about his public position and himself, but he is not a criminal. He is a man driven by ambition and belief, and in these circumstances he can and should be forgiven for this lapse in judgement.

  • It's difficult to see clear justification for Mr. Overland to carry a firearm. Surely police commissioner's have more to do in negotiating with government, liaising with public and private organisations and the media and staying in touch with their members; rather than running around with firerams. At that level, if there's a risk, surely they should have some form of personal protection from trained police? Commissioner's of Police must have more to do with acquiring appropriate resources through government for police members to keep the community safe, explaining operational policing policy in coherent terms to the public and contributing to public safety through effective policy. Seems not. Seems like Simon is enthralled by carrying a gun with real bullets. I hope he's trained properly and maintains his qualifications. If not, there is a double standard and a plastic policeman leading policing in Victoria. Steph.

  • Rossco, you don't understand that the system must come first and its integrity must be maintained at all costs. To do otherwise is not in the public interest. Mr Overland must be given a wider berth when it comes to unlawful conduct. He did not mean to act unlawfully therefore we can afford to overlook such conduct. This principle has been recently confirmed by Justice Bell of the Supreme Court. Mr Overland has so much responsibility we cannot expect him to fully obey every law. What is important is he tries too. Of course it is different if a criminal carries bullets on a plane because we already know from his criminal record he is a pest and burden on society and rightfully deserves the full force of the law.

The government has gutted the police of all the best cops and stacked the management with idiot from interstate and overseas just so they can have complete control of the police. Brumby and Overland have shown the public that they are incompatent fools and both need to go NOW. Yep definately TJF
