Laney Frankland was riding at her local park in Frankston when police approached her and her father and confiscated her 49cc motorcycle.
The family has been told it must pay a $550 fine within 7 days and that the bike would remain impounded for a further 6 months.
Mr and Mrs Frankland paid $400 for the motorcycle initially.
Neil Mitchell spoke to the mother of the little girl, Tracey Frankland, on Thursday morning.

There have been several severe accidents involving mini bikes. They are dangerous. Mini bikes should not be ridden on public parks. He parents should be charged with reckless endagement of a child.
