Hinch detained and banned
UPDATE: Derryn Hinch has received five months home detention and has been banned from broadcasting or publishing during that time for naming sex offenders whose names were suppressed.
A sick-looking and slow-moving Hinch came to court this morning for his sentence straight after a medical procedure for a complication following his recent liver transplant.
The magistrate sentenced him to five months home detention to start immediately and banned the 3AW broadcaster from gainful employment, the use of the internet and publishing or broadcasting during that time; including via social media channels Facebook and Twitter.
He said Hinch may be the last person in Victoria to receive home detention with a bill before parliament to abolish it and said Hinch may want to reflect on the fact there was an alternative to jail next time he entered that debate.
The magistrate said although Hinch said he was against vigilantism his actions were taking the law into his own hands and encouraging others to do it.
He said Hinch's priors meant there was little hope of remorse or changing his ways.
Hinch could not comment afterwards but beforehand said he wanted it out of the way.
Afterwards, his lawyer said no instructions had been received about an appeal.
Hinch's treating surgeon said the five-month lay-off would help his recovery.
Tom Elliott will replace Hinch from Monday, 3AW Program Director Clark Forbes said after the sentence was handed down.
EARLIER: Derryn Hinch will be sentenced today in Magistrates Court for breaching suppression orders by naming two repeat sex offenders.
On June 21st, the 67-year-old asked the judge not to send him to jail, citing his battle with liver cancer and the need to be near a hospital at all times in case of a possible match for a transplant.
On July 5th, Derryn successfully underwent his liver transplant after eight strenuous hours in surgery. Derryn got 'the call' while farewelling a 3AW colleague at a CBD pub.
Last week the broadcaster came home from hospital for the first time.
Asked last week whether the recent turn of events will effect the judge's sentencing, Derryn replied:
"I can't even begin to speculate...Who knows what the judge will decide. I'm just enjoying taking my walks and being alive."
It's been indicated previously Hinch is likely to receive a sentence of several months in home detention.
Yesterday, Hinch underwent further surgery at the Austin to remove a stent and deal with a haematoma that had developed.

Derryn, You Deserve a MEDAL not Home Detention! I am so proud of you for naming Sex offenders, there should be more like you! -One has to wonder about those trying to silence you, what are theyre REAL reasons? -Its a SAD sad day when our judicial system stands up for those filthy scumbags and punishes a man who is simply trying to warn & protect others. I keep asking myself WHY has the judge imposed the ban on you using social media outlets while on Home Detention??? I Personally KNOW of someone who was on HD and was STILL able to travel to and from work Each day! -AND also received 1 hour a week to go shopping !!! -So WHY has this ban been placed only on Derryn Hinch?? SURELY You can appeal this disgraceful gag order Derryn? -Anyway I guaratee there are far more people in society who support What you are trying to do Derryn, than those who dont... Shame on a system which punishes Derryn Hinch for naming sex offenders. Children need to be protected from vermin like those who prey on kids! Let the legal system hang it's head in shame for prosecuting a man who fights for the safety of children!
