P-platers spared demerit points
CLAY LUCAS: More than 1800 P-plate drivers - including the driver in the Mill Park collision that killed five young people last month - were not hit with demerit points for serious driving offences because of an error by VicRoads and the Department of Justice.
VicRoads this afternoon held a media conference to reveal the embarrassing mistake, made over 17 months ago by its officers and Department of Justice workers.
As a result of the error, 1837 P-plate drivers who were fined between July 2008 and November 2008 for carrying too many young passengers did not get the three demerit points they were meant to receive.
Under Victorian road laws, P-plate drivers can carry only one "peer" passenger.
P-plate passengers can lose only five demerit points before their licence is taken from them. Fully qualified drivers can lose 12 demerit points before their licence is taken from them.
Among the 1837 P-plate drivers who did not have demerit points deducted was Steven Johnstone, the driver in the Mill Park crash in January that killed him and four of his passengers.
All drivers affected by the error were fined $350 for their offence, but did not have demerit points deducted from their licence.
Under Victorian road laws, P-plate drivers can carry only one "peer" passenger. A peer passenger is any person aged between 16 and 21, not including the driver's partner or sibling.
