I know you are not meant to 'scandalise the court'. But what about when the court scandalises us? 

What about when the Family Court acts in such an outrageous and, I believe, reckless and dangerous manner, that children are put at risk and it is all because of a judge's ruling.

In this case, two judges' rulings. One in Sydney and one in Hobart.

Listen to these details and see if I am exaggerating. Listen to these court orders and tell me who is looking after the children.

In Sydney a magistrate has ordered a six-year-old girl to live with her father despite evidence she was forced to pose for pornographic photos while staying with him on a contact visit.

The girl was abused by the brother of the father's girlfriend while in her father's care.

I won't go into all the details but this little girl was photographed kneeling on the floor with her underwear pulled down below her bottom. Another photo showed her front on with her underwear pulled down to expose her genitals.

The court was told that the man involved was born with hydrocephalus which meant he had a larger than normal head and brain damage. Which is sad but how did he have access to the child.

Even the magistrate, Robyn Sexton, said there were critical questions to be answered. Like: "How did the girl come to be photographed in pornographic poses while in the father's care, and how did it come about that she was placed in this situation without the knowledge of the father or his fiancée?"

And yet still said the little girl was not at risk. A girl who has never lived with the man before because her parents separated before she was born.

This comes after a case in Hobart  when a Family Court judge ordered two girls, aged eight and ten, to spend weekends with their father who is a registered sex offender.

Oh, there are conditions. He must put a door and a lock on their bedroom and agree to have an 'adult friend' stay over the nights the girls are there.

Justice Robert Bingham, said the girls needed protection from their father at night but thought they could handle him unsupervised while awake and clothed and together.

  • The justice system in this country is protecting no one but the offenders. The judges are throwing these children to the wolves. Are they being paid off???
    They should be held accountable if further offences take place and lose everything dear to them just like these children. No more light sentencing, you'll see!!!

  • my father would abuse me each day from 8years old until i could get away, i was always made by law to go back to live with him,that was along time ago derryn, i am 48 now,the feeling of knowing that i had to go back and face a worse act was just terrifying, how pathetic it is still going on, it makes me sick to the core,how do we make these people understand,what does it take, i have been physically ill, thinking about that little girl, she will carry this abuse forever, please someone listen to the plight of these
    children, wake up you morons in the courts, please wake up.
