Mother wants justice for daughter
On Monday, Neil Mitchell spoke to a young woman who claimed she was raped by another patient at the Eastern Health Mental Facility.
'Alexandra' told Neil on Monday that hospital staff advised her to keep quiet about the incident and tell nobody about it.
On Tuesday, a similar case surfaced on the Mornings Program when 'Jill', the mother of a 22-year old female with mental disabilities (the young woman has the mental capacity of a 10-year-old), told Neil her daughter was sexually assaulted three times in a 48-hour period by three different men while under hospital care.
The alleged assault took place at St. Vincent's Mental Health in Fitzroy, and hospital staff are claiming the sex was consensual, according to the mother.
St. Vincent's, however, have stressed its staff never 'insisted or assumed the sex was consensual'.
A furious Jill says because of her daughter's disability she isn't mentally capable of giving consent to sex.
She told 3AW this case has been swept under the carpet and all she wants is for the hospital to come forward and 'admit they did the wrong thing'.
'Jill' also said another health service had to provide her daughter with the morning after pill due to St. Vincent's being a Catholic facility.
When given a chance to respond to the allegations on air, St. Vincent's refused to comment and accused 3AW of conducting 'trial by media', according to a tweet posted by Neil Mitchell's producer Justin Smith.
They have since released a statement which in part says: "St Vincent's prides itself on compassionate and excellent care for all patients in all of our facilities."
"We have been fully co-operative with the ongoing investigation and await its outcome."
Police investigations are continuing.

I am so angry with hospitals not accepting responsibility for good care. experienced this myself but not as extreme as your daughter. People out there LET'S GET BEHIND THIS!!

Funny how a person with a mental disability can consent to sex while another with the same mental disability can be found not to be able to rationalise so when a criminal act is in question they cannot face court and therefore no responsibility is the go.
So if you ar mentally disabled and a victim you gave the go ahead to the criminal and therefore responsible for what happened to you but if you are a criminal and mentally disabled you are not responsible.
