Crossbencher Derryn Hinch says he’ll refer himself to the High Court if he needs to as he prepares to seek legal advice about receiving a US pension.

The Senator has written to the solicitor general after becoming the latest politician to be caught up in the dual citizenship saga.

The links to the US could disqualify him from the Senate under section 44 of the constitution.

Senator Hinch told Neil Mitchell he paid a social security tax which entitled him to a pension

“If I’m in the wrong, I’ll refer it the High Court,” he said on 3AW Mornings.

Neil Mitchell asked how the personal information was made public.

“Obviously somebody who knows me told The Herald Sun,” Mr Hinch replied.
