Neil Mitchell has discovered disgraced former Labor MP Don Nardella could theoretically be locked in a cell at state parliament over his living expenses scandal.

State Parliament technically has the power to enforce the penalty for ‘contempt of parliament.’

Mr Nardella continually refuses to pay back the $113,000 he wrongly claimed.

‘I would hope there is a better way, but I believe this laws still exists and if they do, then Daniel Andrews has extraordinary power to deal with dodgy Don and the way he’s rubbing our nose in it,’ Neil Mitchell said.

State Opposition leader Matthew Guy said Neil Mitchell was right, but the law could only be enforced with a majority in parliament.

‘That’s why I keep getting so fired up over this,’ he explained.

‘I’m sick to death of seeing Daniel Andrews make excuses as to why he can’t force this man to pay this money back.’
