Why a leading lawyer thinks it’s unlikely the Immigration Minister will cancel Djokovic’s visa
World number one tennis player Novak Djokovic on Monday won his court battle to overturn Australia Border Force’s decision to cancel his visa.
Despite the court ruling, Immigration Minister Alex Hawke has the authority to cancel the Serbian tennis star’s visa again under Section 133c(3) of the Migration Act, barring him from entering the country for three years.
A spokesperson for Mr Hawke says the minister is “currently considering the matter”.
But lawyer at Thomson Geer Lawyers, Justin Quill, says it’s unlikely Mr Hawke will cancel Djokovic’s visa.
“My view is that they won’t do it, they won’t try and boot him out,” he told Tony Jones, filling in for Neil Mitchell.
“The reason I think they won’t do it is because they will know there’s a good chance if they do try and make that decision today that we will wind up back in court this afternoon or tomorrow morning in front of the same judge who was clearly very unimpressed by the Commonwealth’s conduct in the proceeding.
“That judge will grant what’s called an interlocutory injunction, a temporary injunction allowing Djokovic to play.”
